WHY AN AUSTRALIAN VISA, Why a Work Visa or Student Visa?

 

You cannot enter Australia without a visa. An Australian visa is a permission either given electronically as an ETA or by a label on a passport, placed by an Australian Immigration officer, which permits the bearer of the visa to enter Australia lawfully.

They are essential for lawful entry. Hence it’s important for each person to choose the right visa that’s most suitable to their desired activities, purposes, and duration of stay, including permanent residence to Australia.

Most visas are evidenced with a label in the passport. The visa label provides a summary of the migrant’s status, conditions and length of stay.

Note that a visa is a permission to travel to and enter Australia, and/or to remain in Australia.

As you may expect, there are consequences of being an unlawful non-citizen.

An unlawful non-citizen is any person in Australia who does not hold a visa that is in effect.

The consequences may be detention, deportation and exclusion periods imposed either permanent or for up to 3 years for all temporary visa applicants. These would include visitors, working holiday makers, students and temporary business applicants.

General visa requirements:

 

Applicants for most visas must satisfy some general requirements. The general requirements for visas include that the applicant must:

  • satisfy the Public Interest Criteria (‘PIC’) which are set out in Schedule 4 of the Regulations. These include the need to meet health requirements and pass the character test.
  • satisfy the Special Return Criteria which is set out in Schedule 5 of the Regulations. These create exclusion periods and bans on returning to Australia.
  • for some visas, be sponsored by an approved sponsor.
  • for some visas, arrange for an assurance of support to be given (which may also involve payment of a security bond)
  • for some visas, pay a second instalment visa application charge.
